Terms of Service

These Terms govern access to and use of Curèpe, a carpool-coordination service operated by Marescaux Technologies, Inc. By creating an account or using Curèpe, you agree to these Terms.
1. Eligibility and acceptance
You must be at least 18 years old and legally able to agree to these Terms to create or manage a Curèpe account. If you use Curèpe for a family, carpool, or another person, you represent that you are authorized to provide the relevant information and make the selections you submit.
2. What Curèpe provides
Curèpe provides tools for participating families to share availability, coordinate schedules, identify ride-coverage needs, organize volunteer drivers and riders, and receive operational updates. Curèpe is not a transportation carrier, does not provide rides, and does not employ or control volunteer drivers. Families and carpool participants remain responsible for deciding whether a driver, vehicle, route, and arrangement are appropriate for their riders.
3. Participant responsibilities
You agree to provide accurate and current information, promptly communicate material schedule or availability changes, and use information about other participants only for authorized carpool coordination. Drivers are responsible for maintaining any license, insurance, vehicle condition, seating, restraints, and other requirements that apply to them. Parents and guardians remain responsible for their riders and for confirming transportation arrangements.
4. Accounts and security
You are responsible for activity under your account and for protecting access to your devices and authentication methods. Do not share access with an unauthorized person or impersonate another participant. Notify Curèpe promptly through the Feedback option or the contact below if you believe an account or carpool has been accessed without authorization.
5. Schedules and ride information
Schedules, assignments, capacity indicators, routes, notifications, and other coordination information can change and may contain errors or delays. Review the current carpool plan and confirm time-sensitive arrangements directly when necessary. Curèpe is not an emergency service; call 911 or the appropriate emergency service when immediate assistance is needed.
6. Shared participation
A carpool may establish shared-participation expectations for its members. Any acknowledgment presented by Curèpe applies to the identified carpool and version of those expectations. Coordinators and families remain responsible for addressing participation concerns fairly and consistently.
7. Acceptable use
You may not use Curèpe to violate law, harass or threaten another person, submit information you are not authorized to provide, interfere with the service, bypass access controls, probe for vulnerabilities, introduce malicious code, scrape protected participant information, or use carpool information for unrelated commercial or promotional purposes. We may restrict or suspend access when reasonably necessary to protect participants, the service, or legal compliance.
8. Optional text messaging
Curèpe may offer optional SMS or MMS messages for account notices, responses to user-initiated schedule or ride-coordination requests, ride and coverage updates, opt-in confirmations, help, opt-out, and service notices. Curèpe does not use this messaging program for third-party or affiliate marketing.
SMS participation is voluntary and is not a condition of purchasing anything, creating a Curèpe account, or using the core Curèpe application. Enrollment requires a separate affirmative consent action and confirmation from the verified mobile number. Consent may be withdrawn at any time.
Message frequency varies based on your requests, ride activity, and schedule changes. Message and data rates may apply. Your mobile carrier's terms and charges govern your wireless service.
To stop messages, reply STOP. You may also disable optional text messaging from your Curèpe Profile. After opting out, you may receive one confirmation message.
For help, reply HELP. You may also use the Feedback option in Curèpe or email info@marescauxtechnologies.com.
Carriers are not liable for delayed or undelivered messages. Curèpe may suspend or end messaging to comply with carrier rules, protect users, or maintain service security. Do not use text messaging for emergencies. Our Privacy Policy explains how Curèpe handles mobile numbers and messaging consent.
9. Privacy
Our Privacy Policy describes how Curèpe collects, uses, discloses, protects, and retains personal information. Mobile information and messaging opt-in data are not shared with third parties or affiliates for marketing or promotional purposes.
10. Third-party services
Curèpe relies on third-party infrastructure, authentication, communications, mapping, and other service providers. Their availability and processing may be governed by their own terms. Curèpe is not responsible for a third-party service outside its reasonable control.
11. Intellectual property and license
Curèpe and its software, design, branding, and original content are owned by Marescaux Technologies, Inc. or its licensors. Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable license to use Curèpe for its intended carpool-coordination purposes.
12. Feedback
If you submit feedback or suggestions, you permit Marescaux Technologies, Inc. to use them without restriction or compensation, provided that doing so does not grant us ownership of your personal information or carpool content.
13. Suspension and termination
You may stop using Curèpe at any time. We may suspend or terminate access when an account violates these Terms, creates a safety or security risk, is no longer authorized for the relevant carpool, or when reasonably necessary to comply with law. Provisions that by their nature should continue after termination will survive.
14. Service availability and changes
Curèpe may change, suspend, or discontinue features and does not guarantee uninterrupted or error-free operation. We will use reasonable efforts to communicate material service changes when appropriate.
15. Disclaimers
To the fullest extent permitted by law, Curèpe is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. Marescaux Technologies, Inc. does not warrant that schedules, assignments, capacity information, notifications, routes, or participant-provided information will always be accurate, complete, available, or timely.
16. Limitation of liability
To the fullest extent permitted by law, Marescaux Technologies, Inc. and its officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss arising from transportation decisions or conduct by carpool participants. Our aggregate liability for claims relating to Curèpe will not exceed the greater of $100 or the amount you paid to use Curèpe during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Marescaux Technologies, Inc. and its officers and employees from claims, damages, and reasonable expenses arising from your unlawful use of Curèpe, information you submit without authorization, or material violation of these Terms.
18. Changes to these Terms
We may update these Terms as Curèpe changes. We will revise the effective date and provide additional notice when appropriate. Material changes to an optional messaging program may require renewed consent.
